1. THE PROMOTER
The promoter is Canon Europa N.V., registered at Bovenkerkerweg 59, 1185 XB, Amstelveen, the Netherlands ("Canon").
2. ABOUT THE OFFER
2.1. Participants
2.1.1 All Participants must be aged 18 or over.
Distributors and retailers are excluded from the promotion and shall not be eligible to participate on behalf of their customers.
2.1.2 All Participants are deemed to have agreed to be bound by these Terms and Conditions.
2.2. Offer Products, Territory and Periods
2.2.1 Canon will add or remove its products from the Offer list. Please, check the Offer Page for the latest information about the products under promotion.
2.2.2 This offer is now permanent. The qualifying purchase period is 90 days. The purchase period begins from the time the lens or camera are purchased. The starting date is the original date on the proof of purchase.
2.2.3 All Offer Products must be purchased from retailers located within Andorra, Austria, Belgium, Czech Republic, Denmark, The Netherlands, France, Finland, Hungary, Germany, Italy, Norway, Poland, Portugal, Republic of Ireland, Slovakia, Spain, Sweden, Switzerland, United Kingdom, Lichtenstein, Estonia, Latvia, Lithuania, Luxemburg and Monaco or from an Internet store with a domain or a registered address in any of the countries listed above (the "Offer Program Territory").
2.2.4 Participant who purchased ONE camera body is able to claim rebate on ONE purchased lens only.
"This Offer is available in conjunction with only one (1) additional local lens cashback promotion. This Offer is not available for claims on kits, double cashbacks and Canon Online Store lens cashback offers."
2.2.5 All Offer Products must be new and genuine Canon products. Purchases of second hand, refurbished or reconditioned products, or products which are counterfeit or infringe the intellectual property rights of the Canon group companies in any way will not qualify under this Offer.
2.2.6 All the Offer Products must have been supplied to the EEA plus Switzerland or Lichtenstein and distributed by Canon Europa N.V. or Canon group companies located in the EEA, Switzerland or Lichtenstein. 2.2.7 Offer Products returned (free of default) to the seller shall not be valid for the promotion and Participants found claiming for these products shall not be eligible. If Canon becomes aware of any such fraud, it shall be free to take a legal action against any Participants involved.
3. How to Participate
3.1 To participate in the promotion, the Participant must purchase Offer Products AND make a valid claim online. The claim must be made not later than within 30 days after the end of the qualifying period.
3.2 To make a Claim, please complete the following:
(i) Correctly complete and submit an online claim form (including specifying valid product serial number(s) etc.). * For help on where to find your serial number please click here.
(ii) Scan, upload and attach to the online claim form a copy of your till receipt, or order confirmation for internet purchases (including VAT).
(iii) Participants will then receive an email confirming that their claim has been received. If the Participant fails to receive any confirmation email within 24 hours of submitting his/her claim, or does not have access to a computer, please contact our Claim Hotline on +353 16 990 990.
3.3 Upon receipt and verification of the claim, Canon will arrange for a direct BACS transfer payment of applicable amount of rebate set forth in clause 2.2.1 to the Participant’s bank account. No alternative arrangement will be entered into and no cash or cheque will be provided.
3.4 Canon will endeavor to transfer via BACS within 28 days of receipt of a complete and valid claim.
3.5 Where a Participant fails to select one of the currencies offered in the claim form, one may be allocated at Canon’s absolute discretion.
3.6 Canon will not process any claims which are incomplete or illegible. Canon will not be responsible for claims delayed or not successfully received.
3.7 Only one BACS payment will be issued per valid claim.
3.8 If you are VAT registered and you receive a rebate, it may reduce the taxable value of your purchase and so you may need to reduce your input tax accordingly.
4. DISCLAIMERS
4.1. To the fullest extent permitted by law, Canon shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this Offer. However, nothing in these terms and conditions shall have the effect of excluding or restricting Canon’s liability for personal injury or death caused by the proven negligence of Canon’s employees or agents.
4.2. Canon reserves the right to void, amend, and/or change this Offer at any time without incurring any liability whatsoever but will always endeavor to minimize the effect to the Participant in order to avoid undue disappointment.
4.3. Canon reserves the right to audit any claims to ensure compliance with these terms and conditions and to request additional information and supporting documents. Canon reserves the right to exclude claims and/or Participants if it suspects that the Offer is being abused in any way.
Canon’s decisions in relation to the Offer are final and no correspondence will be entered into.
5. DATA
5.1 Canon Europa N.V. and Canon Europe Limited registered in United Kingdom under a registration number 4093977 having a place of business at 3 The Square, Stockley Park, Uxbridge UB11 1ET, United Kingdom are the Data Controllers for the purposes of applicable personal data protection laws and regulations in respect of any personal data supplied by Participants in relation to this promotion. All personal data will be processed by Canon Europa N.V. and/or its group companies solely for the purpose of administering this promotion including supplying the information to third parties appointed to administer the promotion and/or for any authorized marketing purposes. If Participants do not wish for their contact information to be used for marketing purposes or to enable Canon to contact them in future regarding similar promotions, they should NOT check the relevant "opt-in" box when completing the claim form.
6. LAW AND JURISDICTION
If you are a consumer, the Laws of your country of residence will apply to our promotions, and you may be entitled to bring court proceedings in your own language and in your local courts. A local consumer advice organization will be able to advise you of your rights. These Terms and Conditions do not restrict any statutory rights that may be applicable.
